Abstract: Informed consent is increasingly heralded as an ethical panacea, a tool to counter autocratic and paternalistic medical practices. Debate about the implementation of informed consent is constricted and polarised, centring on the right of individuals to be fully informed and to freely choose versus an autocratic, paternalistic practice that negates individual choice. A bioethical framework, based on a principle-led form of reductive/deductive reasoning, dominates the current model of informed consent. Such a model tends to abstract the process of consent from its clinical and social setting. By fleshing out the social process involved when patients and healthy volunteer subjects consent to take part in clinical drug trials, this paper attempts to address the problem arising from the current 'empty ethics' model. My arguments are substantiated by qualitative interview data drawn from a study I conducted on the process of consent as experienced by participants in clinical drug trials.

Comment: This text is a clear critique of the use of informed consent as a medical-ethical panacea (it could be taught alongside O'neill's "Paternalism and Partial Autonomy" for a more accessible and applied look at the problem of informed consent). It would be useful as a contrast at the end of a unit on informed consent for medical treatment or a unit on clinical research ethics. It is especially good for use in a biomedical ethics or research ethics course aimed at students interested in the health professions.

Abstract: Neosentimentalism provides environmental ethics with a theory of value that might be particularly useful for solving many of the problems that have plagued the field since its early days. In particular, a neosentimentalist understanding of value offers us hope for making sense of (1) what intrinsic value might be and how we could know whether parts of the natural world have it; (2) the extent to which value is an essentially anthropocentric concept; and (3) how our understanding of value could be compatible with both a respectable naturalism and a robust normativity.

Comment: This reading is could be used well as a response to Rolston or Callicott's versions of environmental value. The article also covers a number of problems endemic to formal value theory (especially a neosentimentalist theory of the nature of value). It would work best in an upper level undergraduate course on value theory or environmental ethics.

Abstract: This paper argues that the concept of care is significant not only for ethics, but for epistemology as well. After elucidating caring as a five-step dyadic relation, I go on to show its epistemic significance within the general framework of virtue epistemology as developed by Ernest Sosa, Alvin Goldman, and Linda Zagzebski. The notions of "care-knowing" and "care-based epistemology" emerge from construing caring (respectively) as a reliabilist and responsibilist virtue.

Comment: This text is best used in epistemology classes when discussing virtue reliablist and responsibilist approaches, and epistemic success in general. It will also be useful in philosophy of science classes: Dalmiya argues for radical changes in our approach to scientific research, including a redefinition of the epistemic and moral constraints which guide it.

Abstract: Recent developments in neuroscience raise the worry that understanding how brains cause behavior will undermine our views about free will and, consequently, about moral responsibility. The potential ethical consequences of such a result are sweeping. I provide three reasons to think that these worries seemingly inspired by neuroscience are misplaced. First, problems for common-sense notions of freedom exist independently of neuroscientific advances. Second, neuroscience is not in a position to undermine our intuitive notions. Third, recent empirical studies suggest that even if people do misconstrue neuroscientific results as relevant to our notion of freedom, our judgments of moral responsibility will remain largely unaffected. These considerations suggest that neuroethical concerns about challenges to our conception of freedom are misguided.

Comment: Roskies offers an overview of the debate, providing useful glossary of positions related to it together with a graph representing the relations between them. This can be particularly useful when explaining the differences between the metaphysical, epistemic and ethical claims made in this debate.

Diversifying SyllabiChurchland claims that experimental science has gradually (and rightfully and successfully) replaced philosophical investigations of the world, and suggests that the time has come for philosophy of mind and moral philosophy to “cede” to experimental science. She claims that conceptual analysis has been undermined by “a torrent of neuro­psychological results” that contradict folk psychology (i.e. intuition). Thus, self­respecting philosophers of mind have begun to engage with experimental science. Moral philosophers have not yet realized that their field is going in the same direction, and that their stories are about to be superceded by a “naturalistic framework for looking at human morality and decision making” (409). She gives some examples from animal studies bearing on social behaviour and organization like monogamy, trust and cooperation, social attachment, group cooperation or amalgamation. One central point is that moral rules play only a partial role, if at all, in the “brain’s decision” when faced with “constraint­satisfaction problems” (410).

Comment: This text offers a perfect way to address the common reservations regarding the validity and usefullness of philosophy in the age of neuroscience among the students. It clearly distinguishes between the questions which can and cannot be answered empirically, and shows how the aims of philosophy and neuroscience differ. As the text is very approachable, it can easily be used even outside of a philosophy class; in more focused ethics or philosophy of mind classes it might be best accompanied by more specialised texts.

Comment: Particularly useful in teaching is Chapter 10 which discusses abortion, reviewing arguments made by J.J. Thompson and M. Tooley, and enquiring into what makes killing wrong. Chapter 9 looks at distributive justice in medicine, reviewing some problematic cases and distinguishing between bad luck and injustice. Chapter 5 treats on conscientious objection and issues related to toleration and imposition of values.

Abstract: This article critically examines the constitution of impairment in prenatal testing and screening practices and various discourses that surround these technologies. While technologies to test and screen (for impairment) prenatally are claimed to enhance women's capacity to be self-determining, make informed reproductive choices, and, in effect, wrest control of their bodies from a patriarchal medical establishment, I contend that this emerging relation between pregnant women and reproductive technologies is a new strategy of a form of power that began to emerge in the late eighteenth century. Indeed, my argument is that the constitution of prenatal impairment, by and through these practices and procedures, is a widening form of modern government that increasingly limits the field of possible conduct in response to pregnancy. Hence, the government of impairment in utero is inextricably intertwined with the government of the maternal body.

Comment: Most useful in teaching on ethical issues at the beginning of life. It can be also used in teaching on the ethics of autonomy, freedom of choice, and feminism in general.

Abstract: Prenatal screening, consisting of maternal serum screening and nuchal translucency screening, is on the verge of expansion, both by being offered to more pregnant women and by screening for more conditions. The Society of Obstetricians and Gynaecologists of Canada and the American College of Obstetricians and Gynecologists have each recently recommended that screening be extended to all pregnant women regardless of age, disease history, or risk status. This screening is commonly justified by appeal to the value of autonomy, or women's choice. In this paper, I critically examine the value of autonomy in the context of prenatal screening to determine whether it justifies the routine offer of screening and the expansion of screening services. I argue that in the vast majority of cases the option of prenatal screening does not promote or protect women's autonomy. Both a narrow conception of choice as informed consent and a broad conception of choice as relational reveal difficulties in achieving adequate standards of free informed choice. While there are reasons to worry that women's autonomy is not being protected or promoted within the limited scope of current practice, we should hesitate before normalizing it as part of standard prenatal care for all.

Comment: The text introduces the notion of relational autonomy and argues that an increase in pre-natal screening can in fact act so as to restrict the autonomy of pregnant women. It is best used in teaching applied ethics modules on procreation and autonomy, and as a further reading offering a critique of approaches which do not take into account contextual features of particular situations in their moral assessment.

Abstract: Patrick Lenta and Jessica Wolfendale have written two very thoughtful discussions on torture. A central question that arises in responding to these essays in terms of my recent book, Stoic Warriors, is whether ancient Stoicism affords any insights into both the propensity to inflict torture as well as the capacity to endure it. Wolfendale suggests that the learned capacity to endure torture, and in particular, becoming desensitised to pain, may be part of the psychological background that informs a willingness to inflict torture. Training in resisting torture, such as that which special operations troops typically go through, involves not only learning techniques, which can then be reverse engineered in applying torture (what some argue has happened in Guantanamo Bay), but also learning the kind of stress inoculation that makes one willing to use those techniques. In short, military training that involves torture resistance hardens one’s soul and makes one indifferent to the suffering that torture involves. This indifference, Wolfendale claims, is not unlike Stoic apathy. I want to argue, on the contrary, that Stoic apathy is substantively different. However, before making the case, I take up a number of other preliminary points raised in both papers. I conclude with some remarks about interrogation in general.

Comment: This article is useful for post ad bellum discussions in philosophy of war, in addition to being recommended additional reading for political philosophy and ethics.
